Welcome to AjeboChops. These Terms and Conditions ("Terms") govern your use of the AjeboChops mobile application, website, and food delivery services (collectively, the "Service") operated by Ajebo Chops Ltd ("AjeboChops", "we", "us", or "our"), registered at 3 Dr Adewale Oshin Street, Lekki Phase 1, Lagos, Nigeria.
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use our Service.
1. Eligibility
To use our Service, you must:
- Be at least 18 years of age, or have the consent of a parent or legal guardian
- Have the legal capacity to enter into a binding agreement
- Provide accurate and complete information when creating an account
- Be located within our delivery coverage areas
2. Account Registration
You must register for an account to place orders. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised access or security breach
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
3. Orders and Payments
3.1 Placing Orders
When you place an order through the Service, you are making an offer to purchase the selected items. We reserve the right to accept or reject any order. An order is confirmed once you receive an order confirmation notification.
3.2 Pricing
All prices displayed are in Nigerian Naira (₦) and include applicable taxes unless stated otherwise. Prices may change without prior notice, but any changes will not affect orders that have already been confirmed.
3.3 Payment
We accept payment through the methods available in the app, including card payments, bank transfers, and digital wallets. All payments are processed through secure third-party payment processors (e.g., Paystack, Flutterwave). You agree to pay the full amount for your order, including any delivery fees and service charges displayed at checkout.
3.4 Promotional Offers
Promotional codes, discounts, and offers are subject to specific terms and may be withdrawn at any time. Promotional offers cannot be combined unless explicitly stated, and are limited to one use per customer unless otherwise specified.
4. Delivery
- Estimated delivery times are provided as guidance and are not guaranteed. Delivery times may vary based on demand, traffic, weather, and other factors.
- You must provide an accurate delivery address and be available to receive your order. If we are unable to deliver due to incorrect address or your unavailability, we may not be able to issue a refund.
- Risk of loss and damage to items passes to you upon delivery.
- Our standard delivery window is 30–50 minutes, though times may vary.
5. Cancellations and Refunds
5.1 Cancellations
You may cancel an order within a reasonable time before preparation begins. Once food preparation has started, cancellations may not be possible. To cancel an order, use the cancellation option in the app or contact our support team immediately.
5.2 Refunds
Refunds may be issued in the following circumstances:
- Order was not delivered
- Items received are significantly different from what was ordered
- Food quality does not meet reasonable standards
- Incorrect items were delivered
Refund requests must be submitted within 24 hours of delivery. Refunds are processed to the original payment method within 5–10 business days. We may issue refunds as wallet credits at our discretion, which can be used for future orders.
5.3 Non-Refundable Items
We may decline refund requests where the order was delivered as described, or where complaints are made after the 24-hour window, unless there are food safety concerns.
6. Rewards Programme
Our loyalty rewards programme is subject to the following conditions:
- Stamps and rewards are earned based on qualifying purchases only
- Rewards have no cash value and cannot be exchanged for money
- We reserve the right to modify, suspend, or discontinue the rewards programme at any time
- Rewards are non-transferable and linked to your account
- Fraudulent activity will result in forfeiture of all rewards and potential account suspension
7. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the operation of the Service
- Submit false information, fraudulent orders, or abuse promotional offers
- Harass, abuse, or threaten our delivery partners, kitchen staff, or support team
- Use automated tools, bots, or scrapers to access the Service
- Reproduce, distribute, or create derivative works from our content without permission
8. Intellectual Property
All content on the Service — including the AjeboChops name, logo, design, text, images, and software — is the property of Ajebo Chops Ltd or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any of our content without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by Nigerian law, AjeboChops shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or goodwill.
Our total liability for any claim arising from or related to the Service shall not exceed the total amount you paid to us in the 3 months preceding the claim. Nothing in these Terms excludes liability for death or personal injury caused by negligence, or for fraud.
10. Allergies and Dietary Information
While we make reasonable efforts to provide accurate ingredient and allergen information, we cannot guarantee that our meals are free from allergens. If you have food allergies or dietary restrictions, it is your responsibility to review item descriptions and contact us before ordering. AjeboChops shall not be liable for any allergic reactions or adverse effects resulting from food consumption.
11. Third-Party Services
Our Service may integrate with or link to third-party services (payment processors, map providers, etc.). We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.
12. Data Protection
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with the Nigeria Data Protection Regulation (NDPR) and the Nigeria Data Protection Act 2023.
13. Indemnification
You agree to indemnify and hold harmless Ajebo Chops Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
14. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the app, email, or by posting a notice on our website. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
16. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of the Service shall be resolved through:
- Good faith negotiation between the parties
- Mediation, if negotiation fails, administered by a mutually agreed mediator in Lagos, Nigeria
- Binding arbitration under the Arbitration and Mediation Act of Nigeria, if mediation fails
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
